One morning a week, lawyers and law students will be in these courthouses to help those eligible for legal aid. CLS does not represent individuals attempting to become legal guardians, but we refer these cases through our admissions process. CLS`s Division of Aging and Disabilities provides legal advice to people who try to avoid appointing a guardian for them and represents them in certain cases. Free legal assistance to file for guardianship is available for people who: Please note that we cannot answer questions about guardianship of minors. In these situations, Pennsylvania law allows the Orphans Court to appoint a guardian to make decisions in favor of the disabled person. The court may appoint a guardian of the person (to make decisions about life circumstances and health care) or a guardian of the estate (to manage financial matters), or both. A person who is the subject of guardianship proceedings is called a «person who is presumed to be incompetent.» Anyone interested in the well-being of the alleged disabled person may apply for the appointment of a guardian. Guardianship is the legal procedure for a person who takes control of an adult`s affairs when they are unable to manage their own affairs (finances, medical decisions, etc.).

In order for a guardian to be appointed, the court must declare the person «incapable,» meaning that the person is partially or totally unable to manage their financial resources or meet the essential requirements for their physical health and safety. Since a decision that a person is legally incapacitated and the consequent appointment of a guardian take away many important legal rights, the person alleged to have a disability has the right to ask the court to appoint a lawyer to represent him. Sometimes dementias (such as Alzheimer`s disease) or other mental or physical conditions can cause a person to lose their ability to manage their household or finances, or to make informed health care decisions. The person with a disability may be at risk of financial exploitation by others and may not be able to support themselves.
